Mr P Durrant v Warburtons Ltd: 2420093/2020
JUDGMENT
The claims are struck out.REASONS
[1]By a letter dated 25 May 2021 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, by 8 June 2021 ,as to why the claims should not be struck out because the claimant had not complied with the Tribunal’s Orders of 9 January 2021, and the claims had not been actively pursued.[2]The claimant failed to make any representations in writing by 8 June 2021 as to why the claims should not be struck out. He did, however, on 15 June 2021 send to the Tribunal an email. This is a curious document. In it the claimant says this: “Witness statements Tony Bridge As per his statement in my investigation stating we had seeked help during a difficult period to no response given. Michael Kay Jonathon Key Trevor Ieece Chris Molyneox All stating no briefing was ever given or knowledge of any procedure in place. 6.2 Strike out Judgment – claim - rule 37 Case No: 2420093/2020 Chris molyneox stating and providing evidence of Mr Bond illegal corruption and proof that was case was pre judge by lack of confidentiality.”[3]The Tribunal finds this very hard to understand, but it does not address the claimant’s non – compliance with its orders. The claimant remains in breach, and has not given any indication that he will remedy those breaches by taking the steps required to prepare for the final hearing. The claims are therefore struck out. 3. The hearing fixed for 3 August 2021 will not take place. Dated : 21 July 2021
