JUDGMENT
[1]The Claimant was constructively unfairly dismissed.[2]The Claimant is entitled to a basic award of £6073.76 and a compensatory award (past loss) of £1060.66. The Respondent is ordered to pay these sums to the Claimant. Recoupment does not apply.[3]The Respondent unlawfully deducted sums from the Claimants wages between 1st September 2020 and 17th December 2020. The Respondent is ordered to pay the sum of £5767.36 to the Claimant. This sum is calculated on a gross basis.[4]The Respondent unlawfully deducted sums from the Claimant in respect of unpaid holiday. The Respondent is ordered to pay the Claimant the sum of £37.38. This sum is calculated on a gross basis.[5]The claim in respect of unlawful deduction from wages in respect of contributions paid but allegedly not attributed to a pension scheme is hereby stayed until further notice on application from the Claimant and in accordance with the case management of other claims arising from similar facts.
