Employment Judge HorneDate 26 August 2021

JUDGMENT

The claim is struck out.

REASONS

[1]Rule 37 of the Employment Tribunal Rules of Procedure 2013 give the tribunal the power to strike out a claim if it has not been actively pursued.[2]On 17 June 2021 there was a hearing which neither party attended. By a notice sent to the parties on 20 July 2021, the claimant was warned that her claim might be struck out on the ground that it was not actively pursued. She was given an opportunity to make representations as to why her claim should not be struck out. She was also given an opportunity to request a hearing at which the question of striking out could be determined.[3]No such representations or request has been received.[4]The claim is therefore struck out.
