JUDGMENT

[1]The respondent paid the claimant the amount properly payable to him on termination of his employment, and the deduction of 6.5 days’ pay for excess holiday taken but not accrued was a lawful deduction authorised by a provision of the claimant's contract. His claim for holiday pay is therefore dismissed.[2]The respondent unlawfully deducted three days’ occupational sick pay and two days’ statutory sick pay from the claimant's final salary on termination of employment, and the claimant is entitled to payment of those sums totalling £289.81 subject to any statutory deductions that may be payable.
