The claim is struck out.REASONS
[1]Under rule 37 of the Employment Tribunal Rules of Procedure 2013, a tribunal can strike out a claim on the ground that it has no reasonable prospect of success.[2]The claimant has complained of unfair dismissal.[3]Under section 108 of the Employment Rights Act 1996, an employee must be continuously employed for two years before acquiring statutory protection against unfair dismissal. There are exceptions to this rule, but the claimant does not suggest that any of these exceptions apply in her case.[4]By notice dated 19 November 2021, the claimant was given an opportunity to make representations or request a hearing as to why her claim should not be struck out.[5]The claimant has not made any such representations or request.[6]The claim is therefore struck out.
