One day after the Rule 21 Judgment made in the absence of a response was sent to the parties, the respondent’s application for an extension of time to present it was received at the Tribunal with a draft response containing arguable grounds of resistance. Although the claimant has not had the opportunity normally afforded by Rule 20 to object, the accompanying letter adequately explained the delay such that an extension of time is granted by the Judge of his own initiative under Rule 73. Accordingly, the response is accepted and the Rule 21 Judgment is set aside.
