The judgment of the tribunal is that the claim is struck out.REASONS
[1]The claimant presented a complaint of unfair dismissal. He stated that he was employed from 29 May to 10 December 2018.[2]Under s 108 of the Employment Rights Act 1996 a person only acquires the right to complain to an employment tribunal of unfair dismissal if they have been continuously employed for 2 years.[3]By a letter dated 3 January 2019 the tribunal gave the claimant an opportunity to make representations as to why the claim should not be struck out because he insufficient continuous employment.[4]The claimant has failed to make any representations why this should not be done or to request a hearing.[5]The claim is therefore struck out.
