Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The claimant was dismissed in breach of contract in respect of notice and the respondent is ordered to pay damages to the claimant in the net sum of £642.92. The claimant mitigated his loss fully by finding alternative employment from 16 April 2018 and is awarded 2 weeks’ net loss of earnings until then at his net weekly pay of £321.46.[2]The claimant was dismissed by reason of redundancy and is entitled to a redundancy payment of £2884.58 (representing 7.5 weeks’ pay based upon 9 years continuous service at the relevant date, of which 6 were when aged over 22 years. His week’s pay was £384.61 based upon £1666.67 gross per month).[3]The respondent has failed to pay the claimant’s holiday entitlement and is ordered to pay him the gross sum of £384.61 (1 week’s pay).[4]The hearing is not relisted.
