JUDGMENT

[1]The claims of breach of contract, unpaid wages and unpaid untaken annual leave are well founded and succeed.[2]The respondent dismissed the claimant in breach of contract and is ordered to pay her 1 week’s pay amounting to one hundred and fifty pounds (£150) net of statutory deductions.[3]There was an unlawful deduction from the claimant’s wages in the sum of thirty nine pounds (£39) (net) for a 9 to 2 unpaid Sunday shift.[4]There was an unlawful deduction from wages when the claimant worked unpaid on the 7 September for 12 hours at a rate of seven pounds and thirty eight pence an hour totalling seventy five pounds net (£75).[5]The claimant incurred nine pounds and sixty pence in lawful expenses which, in breach of contract have not been reimbursed. The respondent is ordered to pay compensation in the sum of nine pounds and sixty pence (£9.60)[6]On the date of her dismissal the claimant had accrued 5 days annual leave of which she had taken 1. The respondent is ordered to pay the claimant for 4 days’ accrued and untaken leave which amounts to three hundred pounds (£300) net[7]In total the respondent is ordered to pay the claimant the sum of five hundred and seventy three pounds and 60 pence.
