JUDGMENT
[1]The claimant’s complaint of unpaid wages was not presented before the end of the period of three months, beginning with the date of payment of the wages from which the deduction was made, contrary to section 23(2)(a) Employment Rights Act 1996.[2]The Tribunal was satisfied that it was reasonably practicable for the complaint to be presented before the end of the three month period and it was therefore not reasonable to extend the time limit in accordance with section 23(4) Employment Rights Act 1996.[3]Accordingly, the Tribunal did not have jurisdiction to hear the claimant’s claim and it is dismissed.
