JUDGMENT

[1]The claimant was not constructively dismissed. Her claims of unfair dismissal and wrongful dismissal are therefore not well-founded and are dismissed.[2]The respondent must pay the claimant the gross sum of £288.46 in respect on unpaid holiday pay.[3]The respondent made unlawful deductions from the claimant’s wages. The claimant is awarded the gross sum of £49,106.69 in respect of unlawful deductions from wages.[4]The sums awarded above are gross figures. The respondent should make the necessary tax deductions at source, and pay the claimant the outstanding balance. Where deductions are not made by the respondent, the claimant will be responsible for accounting for any tax liabilities from those gross payments.
