JUDGMENT
Employment Tribunals Rules of Procedure 2013 – Rule 21[1]I declare the claimant is entitled to a redundancy payment of £4,067.28. (6 years service x 1.5 x £451.92). The respondent has paid the claimant a redundancy payment of £3,389.40 and £200.Therefore the respondent has made an unauthorised deduction from wages of £477.88 by failing to pay the claimant the full amount of redundancy payment due.[2]The respondent has failed to pay the claimant 17 days accrued but untaken holiday pay on the termination of employment in the sum of £1536.46 (£90.38 x 78)[3]The respondent has made an unlawful deduction from wages by failing to pay £386 SSP.[4]The respondent is ordered to pay the claimant £2,400.34 within 14 days of this Judgment The hearing fixed for 17 February 2020 is vacated.
