[2]Section 108 of the Employment Rights Act 1996 requires a claimant to have not less than two years service to make an unfair dismissal complaint.[3]The claimant was employed by the respondent for less than two years.[4]Therefore the claimant is not entitled to bring such a complaint.[5]The claimant has failed to give an acceptable reason, despite being given the opportunity to do so, why the complaint should not be struck out.[6]Accordingly, the complaint of unfair dismissal is struck out. The claimant’s other complaints are not affected by this judgment. ________________________ Employment Judge Buzzard Date: 7 January 2020[1]Wrongful dismissal One weeks notice pay at £131.36 gross (5 to 11 October 2019) 131.36 Case No. 2414755/2019 2[2]Unfair dismissal for asserting a statutory right 3 weeks pay (12 October to 4 November) 394.20 3.holiday pay 14 days (proportionate to the period of employment 22 February 2019 to 5 October 2019) X 4 hours (hours worked per day) x £8.21 (hourly rate) 459.76 Total award 985.20
