Mr L Sinclair v Grundy & Co Excavations Ltd: 2414583/2019
JUDGMENT
The complaint of unfair dismissal is struck out.REASONS
[1]By a letter dated 5 February 2020 the Tribunal gave the claimant an opportunity to make representations as to why the complaint of unfair dismissal should not be struck out on the basis that the Tribunal does not have jurisdiction to hear the complaint as the claimant appears to have less than two years’ service.[2]The claimant has failed to make representations in writing why this should not be done. The complaint of unfair dismissal is therefore struck out.[3]The claimant’s remaining claims of breach of contract, unauthorised deductions from pay and holiday pay remain listed for hearing on 12 March 2020. Employment Judge Benson Dated 25 February 2020[1]The respondent has made unauthorised deductions from the claimant’s wages.[2]The respondent is ordered to pay to the claimant the sum of £518.48 net. All other claims are dismissed.
