JUDGMENT
The respondent having failed to present a response within the time prescribed by rule 16 of the Employment Tribunal Rules of Procedure 2013 the judgment of the tribunal is that:[1]The claimant’s complaints for a redundancy payment and for breach of contract (notice pay) are well-founded.[2]The respondent is ordered to pay the claimant a redundancy payment calculated as follows: Total service 17 years (in all of which the claimant was over 41 years old) 17 weeks x 1.5 x £346 gross per week = £8,823.00[3]The respondent is further ordered to pay the claimant compensation for breach of contract calculated as follows: 12 weeks’ notice period (s.86 (1)(c) Employment Rights Act 1996 x £300 per week (net) = £3,600.00[4]The respondent is ordered to pay the resulting sum of £12,423.00 to the claimant on or before 24 October 2018.
