JUDGMENT

[1]The claimant has permission to amend her claim to include a claim of breach of contract in respect of notice pay.[2]The claimant’s complaints of unfair dismissal and breach of contract are wellfounded.[3]The respondent is ordered to pay compensation to the claimant in respect of breach of contract in the sum of £1465.40 calculated as follows. 6 weeks at £222.03 1332.18 ACAS uplift - 10% 133.22 £1,465.40[4]The respondent is ordered to pay compensation to the claimant in respect of unfair dismissal in the following sums: Basic Award 7 weeks x 1.5 x £234.90 £2,466.55 Compensatory Award Loss of earnings - 8.6 weeks at 222.03 1,909.46 loss of employer’s pension contribution 32.41 less sums earned by claimant in the same period -245.00 1,696.87 Expenses of seeking employment 50.00 Loss of statutory rights 300.00 Sub-total 2046.87 ACAS uplift -10% 204.69 £2,251.56 Total £4,718.11[5]The Employment Protection (Recoupment of Benefits) Regulations 1996 apply to the award for unfair dismissal and the tribunal states, for the purposes of those regulations, as follows: Monetary award grand total £4718.11 Prescribed period - 16 July 2018 to 5 December 2018 Prescribed element £1696.87 Excess of grand total over prescribed element £3021.24[6]The sums awarded under paragraphs 3 and 4 above shall be paid on or before 20 December 2018.
