JUDGMENT
[1]The first respondent has failed to comply with the requirements of section 188 of the Trade Union and Labour Relations (Consolidation) Act 1992. The claimants’ claim for a protective award brought under S189 of that Act succeeds.[2]The first respondent is ordered to pay to the employees of the respondent, named in the attached schedule, remuneration for a protected period of 90 days from 18th August 2021.[3]The recoupment regulations apply to this award.
