The claim is struck out.

REASONS

[1]The case was listed for a preliminary hearing on 23 January 2020.[2]The Tribunal was informed that settlement had been agreed through ACAS. On 10 January 2020 the Tribunal wrote to the claimant asking him to withdraw his claim by 17 January 2020. He did not reply. Nor did he attend the hearing. Instead he confirmed in response to a telephone enquiry that the case has been settled.[3]There has been no withdrawal of the claim within rule 51. The case is therefore struck out under rule 37(1)(d) because it has not been actively pursued. I consider that the claimant has had a reasonable opportunity to make representations because he could have responded to our letter of 10 January 2020 and/or attended the hearing on 23 January 2020.
