JUDGMENT

[1]The proceedings on the complaints contained within the claim were not brought before the end of 3 months starting with the date of the acts to which the claim relates in accordance with section 123(1)(a) of the Equality Act 2010.[2]Nevertheless, it is just and equitable to permit the proceedings to be brought out of time in accordance with section 123(1)(b) of the Equality Act 2010.[3]The claim shall now proceed to the final hearing listed on 25-29 July 2022 and in accordance with the case summary, case management orders, and list of complaints and issues settled at the case management hearing on 10 February 2021.[4]The Tribunal notes that the claimant’s status as a disabled person for the purposes of his claim is now conceded. _____________________________ Judge Brian Doyle Date: 29 July 2021
