JUDGMENT
The claimant’s claims of Unfair Dismissal, Pregnancy Discrimination, Breach of Contract and for Unpaid Holiday are dismissed.REASONS
[1]Ms Stephenson has failed to attend the final hearing listed for three days starting today at 10.00am in the Manchester Employment Tribunal.[2]Ms Stephenson had made no application to postpone the hearing or provided any explanation in advance of the hearing.[3]Ms Stephenson had not attended a preliminary hearing held on 10th February 2023 at which directions for the final hearing were given. Notice of today’s hearing and a record of that preliminary hearing was sent to Ms Stephenson by email at the address provided by her and from which she had communicated with the Tribunal.[4]Practicable enquiries were made this morning; an administrative officer telephoned and spoke with Ms Stephenson. She stated that she was at work and had not realised that the hearing was today.[5]I am satisfied that Ms Stephenson had received the notice of hearing and directions – with which she has not complied – and that she was aware of today’s hearing. Ms Stephenson has provided no satisfactory explanation for her failure to attend.[6]I am exercising my power pursuant to Rule 47 ET(C&RP) Regs 2013. The claim is dismissed due to Ms Stephenson’s failure to attend today’s hearing.
