JUDGMENT

Under Rule 21 Employment Tribunals Rules 2013 The judgment of the Tribunal is that:[1]The Tribunal does not have jurisdiction to hear the claimant’s claims under Case Number 2413528/2020[2]The claimant was unfairly dismissed and her claim of unfair dismissal under Case Number 2400606/2021 succeeds.[3]The respondent is ordered to pay to the claimant a basic award in the sum of £2720.64.[4]The respondent is also ordered to pay to the claimant compensation for loss of statutory rights in the sum of £500.[5]The Tribunal does not make an award of compensation for loss of earnings after the date of dismissal.[6]The claimant’s claim for payment in lieu of holidays accrued but not taken at the date of termination is well founded and succeeds.[7]The respondent is ordered to pay to the claimant the sum of £1469.83 as payment in lieu of 52 hours holiday accrued but not taken in 2019, and 119.6 hours holiday accrued but not taken in 2020.[8]The recoupment provisions do not apply to any part of this award.
