The claim is struck out.REASONS
[1]The claimant did not attend the hearing today. The Tribunal clerk attempted to contact him at the start of the hearing by telephone and email, but the claimant did not respond.[2]The Tribunal was satisfied that the claimant had received notice of the hearing today. Today’s hearing had been listed for 27 June 2024 but postponed for a lack of judicial resources and relisted for today.[3]The claimant attended a case management hearing before Employment Judge Holmes on 21 May 2024 at which case management orders had been made that the claimant had to comply with by 18 June 2024. The claimant has not complied with either of these case management orders.[4]There has been no correspondence from the claimant to the Tribunal since the case management hearing on 21 May 2024. The respondent’s counsel told the Tribunal that the respondent’s solicitors have attempted to agree the agenda and list of issues Case No. 2413171/2023 for today’s hearing with the claimant on three separate occasions, namely 4 July, 19 August and 20 August 2024, but he has not responded to them on any of those occasions.[5]The claimant has failed to comply with case management orders and is not actively pursuing his claim. He has had an opportunity at this hearing to make representations as to why his claim should not be struck out but he did not attend.[6]The claim is therefore struck out under rule 37(1)(c) and (d) of the Employment Tribunals Rules of Procedure 2013.
