JUDGMENT

Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The respondent has made an unauthorised deduction from the claimant's wages and is ordered to pay the claimant the gross sum of £312.60.[2]The claimant was dismissed in breach of contract, and is entitled to damages in respect of:a. notice and the respondent is ordered to pay damages to the claimant in the gross sum of £1,096.10 andb. fuel costs to which he was contractually entitled , and the respondent is ordered to pay damages to the claimant the sum of £161.00 (which is not liable to any tax liability being reimbursement of expenses).[3]The claimant was dismissed by reason of redundancy and is entitled to a redundancy payment of £1,644.15.[4]The claimant will be responsible for paying any tax liabilities arising out of the gross award if they receive these sums gross and tax is not deducted at source.
