Mr Whalley v Kerr Capital Developments Ltd: 2411741/2023
JUDGMENT
The claim is struck out.REASONS
[1]By a letter dated 22 February 2024 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the claim should not be struck out because: On the grounds that the claims have not been actively pursued and/or you have failed to comply with the Tribunal’s orders, as set out in the letter from the respondent’s representative dated 24 January 2024[2]The claimant has failed to make representations in writing, or has failed to make any sufficient representations, why this should not be done or to request a hearing. The claim is therefore struck out.[3]The hearing fixed for 16 and 17 September 2024 will not take place.
