JUDGMENT
[1]The claimant was unlawfully discriminated against on the grounds of his race and his claim for direct discrimination, harassment and victimisation are wellfounded.[2]The respondent is ordered to pay to the claimant damages for injury to feelings in the sum of £27,000 (twenty-seven thousand pounds) together with interest at a rate of 8% from 3 March 2016 to 1 October 2020 (1308 days @ 8% of £73.97 £5.91 per day) £7740.49 (seven thousand and seven hundred and forty pounds forty-nine pence).[3]The claimant was unfairly dismissed and his claim for unfair dismissal is wellfounded.[4]The respondent is ordered to pay to the claimant, (who was 54 years of age at the effective date of termination and in receipt of gross pay in the sum of £447.50 and net £380 per week) damages for unfair dismissal in the sum £15,876.90 consisting of a basic award £2013.75 (4.5 weeks @ £489 gross), and a compensatory award totalling £13863.15 consisting of loss of earnings from 19 January 2018 to 9 January 2020 at £10,408.52 net, loss of pension contributions £182.00, loss of statutory rights £500 and a 25% uplift of £2772.63 for failure to 1 of 4 comply with the relevant ACAS Code of Practice in respect of the grievances and dismissal.[5]The Recoupment Regulations do not apply.
