Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The complaint of unauthorised deductions from pay is well founded. The respondent is ordered to pay the claimant the gross sum of £2,351.88 calculated as follows: Pay for July 2019 £2,153.14 Pay for 1 and 2 August 2019 £ 198.74 Total £2,351.88[2]The claimant was dismissed in breach of contract in respect of notice and the respondent is ordered to pay damages to the claimant in the sum of £2,481.68 calculated as follows: 12 weeks’ net pay £5,054.88 Less net earnings 9/8 – 27/9/19 £2,573.20 Total £2,481.68[3]The respondent has failed to pay the claimant’s holiday entitlement and is ordered to pay the claimant the net sum of £1,263.60.[4]The unfair dismissal complaint is well founded. The claimant was unfairly dismissed. The respondent is ordered to pay the claimant a basic award of £14,906.10. No compensatory award is made because the business ceased trading and the claimant would have been dismissed at the same time even if the respondent had acted fairly.
