JUDGMENT
Employment Tribunals Rules of Procedure 2013 – Rule 21[1]It is DECLARED that the respondent victimised the claimant, and he discriminated against her by treating her unfavourably because of her pregnancy, on 15th June 2019 and by failing to pay to the claimant statutory maternity pay due to her prior to termination of the claimant’s employment (effective upon her receipt of late notification that she had been dismissed on 8th April 2019) as alleged. The claimant’s claims made under sections 18 and 27 Equality Act 2010 succeed.[2]This claim coincided with the claimant’s claims against the respondent in case numbered 2406162/2019. The claimant was awarded £18,652.39 by way of damages for injury to her feelings, aggravated damages, interest and compensation for financial losses in relation to the period of this current claim (they over-lap); in those circumstances no further financial award is made.[3]Subject to any successful application for re-consideration, no further hearing is required or will be listed. This judgment finalises the litigation under this claim number and, by reference, that under number 2406162/2019.
