JUDGMENT
Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The respondent has made an unauthorised deduction from the claimant's wages and is ordered to pay the claimant the gross sum of £830.79.[2]The claimant was dismissed in breach of contract in respect of notice and the respondent is ordered to pay damages to the claimant in the sum of £1846.20. This is a net figure but has been calculated using gross pay because of the likelihood that the claimant will have to pay tax on it as “Post Employment Notice Pay.”[3]The respondent has failed to pay the claimant’s holiday entitlement and is ordered to pay the claimant the gross sum of £895.41.[4]The respondent failed to provide the claimant with a written statement of the main terms of employment and is ordered to pay the claimant the gross sum of £1,846.20 representing four weeks’ pay.[5]No award is made in relation to the failure to enrol the claimant into a pension scheme or for the failure to make employer’s contributions. The Tribunal has no jurisdiction over those matters, which should be taken up with the Pensions Regulator.
