Mr B Bailey v Prosperous Life Ltd: 2411235/2019
JUDGMENT
[1]The claimant’s claim is dismissed by reason of his non-attendance.REASONS
(1) By letter from the tribunal dated 29 October 2019 the parties were informed that this matter would be heard at Manchester Employment Tribunal at 10.00am today.(2) By letter dated 9 December 2019 the parties were informed that the respondent had failed to present a response and that the hearing would go ahead on 24 January.(3) By 10.15am the claimant had not attended and no message had been received from him. There was no request for postponement or other recent correspondence on the file. An attempt was made to telephone the mobile phone number given in the claim form but there was no answer and no answering service.(4) By 11.00am the claimant had still not attended and no message had been received. Case No: 2411235/2019(5) Rule 47 of the Employment Tribunal Rules of Procedure permits a claim to be dismissed where a party has not attended the hearing of the claim. Before dismissing the claim, I have to consider, so far as I am able, the reasons for non-attendance. As no reason has been given for nonattendance and there is nothing to suggest that this claim is being actively pursued, I consider it appropriate to dismiss the claim.
