Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The title is amended to Kam Enterprises Limited to reflect the correct title of the respondent.[2]The respondent has failed to present a valid response on time. The Employment judge has decided that a determination can properly be made of the claim, in accordance with Rule 21 of the Rules of Procedure.[3]The respondent has made an unauthorised deduction from the claimant's wages and is ordered to pay the claimant the gross sum of £2,235.47.[4]This figure is calculated as follows:-a. underpayment of wages from June 2023 of £747.37b. underpayment of wages from July 2023 of £654.50c. underpayment of wages from September 2023 of £833.60[5]The respondent has failed to pay the claimant’s accrued untaken leave entitlement on termination of employment and is ordered to pay the claimant the gross sum of £1,073.26.[6]The claimant will be responsible for paying any tax liabilities arising out of the gross award if they receive the gross figure and tax is not deducted from source.[7]The hearing listed on 12 August 2024 is cancelled.
