JUDGMENT
[1]the claimant’s claim of unfair dismissal is well-founded. The respondent is ordered to pay to the claimant the sum of £9,116.27 for his unfair dismissal comprising of a basic award of £5,775.00 and a compensatory ward of £3,341.27.[2]The Employment Protection (Recoupment of Job Seeker's Allowance and Income Support) Regulations 1996, SI 1996 No. 2349 apply to the following:(a) Monetary award: £9,116.27(b) Prescribed element: £2,173.02(c) Period to which (b) relates: 10 August 2019 – 1 September 2019(d) Excess of (a) over (b): £6,943.25[3]The claimant was dismissed in breach of contract in respect of notice and the respondent is ordered to pay damages to the claimant in the net sum of £7,967.74.[4]The respondent has made unauthorised deductions from the claimant's wages and is ordered to pay the claimant the net sum of £759.27 and to pay the further sum of £181.00 to the Student Loan Company on the claimant’s behalf.[5]The respondent has failed to pay the claimant’s full holiday entitlement due at the termination of his employment and is ordered to pay the claimant the agreed gross sum of £269.59.[6]The claim for a redundancy payment is dismissed upon withdrawal by the claimant.
