JUDGMENT

The judgment of the Tribunal is that the claimant was an employee of the respondent and consequently her complaints of constructive unfair dismissal contrary to section 103A of the Employment Rights Act 1996 and detriment contrary to section 47B of the Employment Rights Act 1996 may proceed to a final hearing. The respondent’s application that a deposit order be made against the claimant was successful and is recorded by way of a separate Order.

REASONS

[1]By a Deposit Order sent to the parties on 3 October 2018 the Tribunal ordered that the claimant was to pay a deposit of £400 in order for the claim to continue.[2]That deposit was not paid.[3]The claim is therefore struck out.[4]The hearing fixed for 5 March 2019 to 7 March 2019 will not take place.
