JUDGMENT
[1]The claimant’s claim for unfair dismissal succeeds.[2]The respondent shall pay to the claimant compensation in the sum of £1610.24 (ONE THOUSAND SIX HUNDRED AND TEN POUNDS AND TWENTY FOUR PENCE) broken down as follows: a basic award of £450 (FOUR HUNDRED AND FIFTY POUNDS) and a compensatory award of £1160.24 (ONE THOUSAND ONE HUNDRED AND SIXTY POUNDS AND TWENTY FOUR PENCE).[3]Regulation 4 of the Employment Protection (Recoupment of Benefits) Regulations 1996 applies in this case. The Prescribed Element is £708.90. The Prescribed Period is 2 February 2018 to 9 March 2018. The total monetary award is £1610.24. The excess of the total monetary award over the Prescribed Element is £901.34[4]The respondent’s application for costs is refused.
