JUDGMENT

Employment Tribunals Rules of Procedure 2013 – Rule 21 UPON the Claimant attending the hearing on 13th March 2023 and giving evidence in support of his claim AND UPON the Respondents not attending the hearing IT IS ORDERED THAT:[1]The claims against the Second and Third Respondents are dismissed upon withdrawal.[2]The Claimant’s claim for unlawful deduction of wages is well founded. The Respondent has made an unlawful deduction from the Claimant’s wages and is ordered to pay the Claimant the gross sum of £1825.00.[3]The Claimant’s claim for failure to pay in lieu of annual leave is well founded. The Respondent has failed to pay the Claimant in lieu of accrued but untaken annual leave upon the termination of his employment and is ordered to pay the Claimant the gross sum of £547.50.[4]Pursuant to s24(2) of the Employment Rights Act 1996, the Respondent is ordered to pay the Claimant the gross sum of £91.25, which has been sustained by him and is attributable to the unlawful deductions.[5]The total sum the Respondent is ordered to pay the Claimant is therefore £2463.75 gross, payable within 14 days of receipt of this order.
