JUDGMENT
[1]Claims 2409683/2023(1) and 2409684/2023(2) for unlawful deduction of wages and unpaid holiday pay are struck out as they are duplicates of the claims 2408954/2023 and 2408955/2023 which have already been determined in the Claimants’ favour.[2]For the avoidance of doubt, a third matter (2408956/2023) which was linked to 2408954/2023 and 2408955/2023 has not been struck out and continues.REASONS
[3]The Claimants have issued claims under case number 2409683/2023 (1) and 2409684/2023 (2). On 31st January 2024 Employment Judge Fairhurst considered the matters of 2408954/2023 and 2408955/2023 which are identical in substance to the matters before me today.[4]I consider it appropriate that the duplicate claims under case numbers 2409683/2023(1) and 2409684/2023(2) should be struck out and issue a judgment accordingly. Case No: 2409683/2023 (1) 2409684/2023 (2)[5]Given that the Claimants were not in attendance at the hearing today, should they have any grounds to argue that this is in any way prejudicial to them, they should apply for reconsideration of the judgment striking out the duplicate claims.
