Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The respondent has made unauthorised deductions from the claimant's wages in August 2022 of £1208.33 and in September 2022 of £225.85. The respondent is ordered to pay the claimant the gross sum of £1434.18.[2]The claimant was dismissed in breach of contract in that the respondent failed to provide the claimant with one week’s notice. The respondent is ordered to pay damages to the claimant in the sum of £545.14. This has been calculated using gross pay to reflect the likelihood that the claimant will have to pay tax on it as ‘Post Employment Notice Pay’.[3]The respondent has failed to pay for the claimant’s accrued untaken holidays, amounting to 27.75 days. The respondent is ordered to pay the claimant the gross sum of £2785.51.
