JUDGMENT
[1]The claimant’s claim for unfair dismissal was presented within time having regard to the special provisions s.207B(3) ERA 1996 and s.207B(4) ERA 1996.[2]The claimant’s claim for unfair dismissal is well founded and succeeds.[3]The claimant’s claim for Unlawful Deduction from Wages, pursuant to Section 13 Employment Rights Act 1996 is within time, is well founded and succeeds. The respondent is ordered to pay the claimant £771 payment in lieu of accrued but untaken holidays on termination of employment, within 14 days of the date of this judgment. Remedy for Unfair Dismissal[4]I award the claimant the following compensation. Basic Award £ 1,000 Compensatory Award (taking into account a 50% deduction for contributory fault) For the period from dismissal to 3 November 2020 £ 5,782 Case No. 2409516/20 2 For the period 4 November 2020 to 3/5/2021 (including loss of statutory rights and taking into account sums earned in other employment and then making a 50% reduction for contribution fault) £701.73[5]The Grand Total of compensation is £7,483.73 payable within 14 days of this judgment.[6]The Prescribed Element is £5,782.[7]The Prescribed Period is 25/3/20 to 3/11/20.[8]The sum unaffected by the Prescribed Element and payable direct to the claimant is £1,701.73.[9]The Recoupment Regulations apply to this Unfair Dismissal Award.
