The claim is struck out.REASONS
[1]By a letter dated 31 January 2023 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the claim should not be struck out.[2]This was on the basis that the appeared to have no reasonable prospect of success because it relates to a dismissal which took place in 2019 and which was subject to a previous Tribunal claim. Employment Judge McDonald ordered the claimant to explain why he considered that the claim did have prospects of success and should be allowed to proceed. The claimant has not replied to that correspondence[3]The hearing fixed for 14 March 2023 will not take place.
