The claim is struck out.REASONS
[1]Rule 37 of the Employment Tribunal Rules of Procedure 2013 gives the tribunal the power to strike out a claim if it has not been actively pursued.[2]This claim was listed for hearing on 3 February 2021. The claimant and respondent did not attend on that day.[3]Following the hearing, Employment Judge Newstead-Taylor caused a letter to be sent to the parties, warning them that the tribunal was considering striking out the claim on the ground that it was not actively pursued. The claimant was given an opportunity to make representations or request a hearing as to why her claim should not be struck out.[4]The claimant has not made any such representations or request.[5]The claim is therefore struck out.
