JUDGMENT
The judgment of the Tribunal is that:(1) The respondent admitted in section 6.1 of its form ET3 presented on 30 November 2023 that the claimant is entitled to: (a) Unpaid salary in the gross sum of £6250.00, (for May 2023). (b) Unpaid salary in the gross sum of £3461.52, (for 1 to 16 June 2023 when their employment terminated). (c) Unpaid holiday entitlement accrued at the date of termination in the gross sum of £1,153.84, (4 days accrued). (d) Salary deductions in respect of personal pension contributions in the sum of £961.54.(2) The respondent must therefore pay the claimant the total sum of £11,826.90 in settlement of their original complaints of unlawful deduction from wages and holiday pay.(3) The claimant accepts that the Tribunal does not have jurisdiction to determine the complaint in respect of unpaid pension contributions which should have been made by the respondent on the claimant’s behalf and this complaint is dismissed upon withdrawal by the claimant.(4) This judgment is made without prejudice to the other complaints raised by the claimant relating to the gratuity payment, shares and ACAS Code uplift. Further case management orders are made in respect of these outstanding complaint in the Note of Preliminary Hearing dated 22 February 2024 and sent separately to the parties.
