JUDGMENT
The complaint of disability discrimination is struck out.REASONS
[1]By a letter dated 18 May 2021 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the complaint of disability discrimination should not be struck out because the claimant had not complied with the Order of the Tribunal made following the hearing on 26 February 2021.[2]The claimant has failed to make representations in writing, why this should not be done or to request a hearing. The complaint of disability discrimination is therefore struck out.[3]The claimant’s remaining claim of unfair dismissal remains listed for hearing on 18 and 19 November 2021, but will now be heard by an Employment Judge sitting alone rather than a full panel. If the claimant has not done so, he must provide his documents to the respondent as soon as possible (see order 5.1 of the order following the hearing on 26 February 2021).
