JUDGMENT
[1]The respondent made an unauthorised deduction from wages by failing to pay the claimant in lieu of accrued but untaken annual leave on termination of employment and is ordered to pay to the claimant the sum of £648.00 gross (made up of 9 days x £72).[2]The Tribunal calculates the amount of payment on a gross basis, but the respondent is entitled to make any deductions which are due for tax and national insurance contributions before payment is made to the claimant.[3]The respondent’s counterclaim is dismissed.
