JUDGMENT

Employment Tribunals Rules of Procedure 2013 Rules 53 and 56[1]The complaint about notice pay is dismissed upon its withdrawal by the claimant.[2]The claimant shall be permitted to amend her claim to include a complaint of unauthorised deductions from wages in respect of overtime worked on Saturday 8 May 2021.[3]The complaint of wrongful dismissal in relation to an allegation of breach of contractual procedures is struck out.[4]The complaint of direct age discrimination is struck out.[5]The claimant’s application to amend her claim to include a complaint of harassment because of age is refused.[6]The remaining 2 complaints, of unauthorised deductions from wages and of a failure to allow the claimant to be accompanied at the meeting at which she was dismissed, shall proceed to a final hearing listed on 26 September 2022, subject to the Deposit Order in respect of the complaint of a failure to allow the claimant to Case No: 2408809/2021 be accompanied to the dismissal meeting, (which shall be issued separately to this Judgment). _____________________________ Employment Judge Batten Date: 1 March 2022
