The claim is struck out.REASONS
[1]By case management orders dated 27 July 2023 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the claim should not be struck out because it has not been actively pursued. In particular:• The parties were notified by the Tribunal by e-mail on 19 April 2023 that there would be a telephone hearing at 2.15pm on 19 July 2023;• The respondent reminded the claimant by e-mail on 17 July 2023 that the hearing would take place on 19 July 2023;• The parties were notified again by the Tribunal by e-mail on 18 July 2023 of the start time for the hearing;• The claimant did not connect to the telephone hearing;• The claimant did not make contact with the Tribunal by any means to explain why she was not attending;• The respondent’s representative informed Employment Judge Horne that the claimant had not made contact with the respondent since April 2023;• The Tribunal clerk telephoned the claimant between 2.30pm and 2.38pm on the afternoon of the hearing, using the telephone number provided by the claimant in her claim form but received an automated message stating that the number was not recognised; Case Number: 2408551/2022• The Tribunal clerk e-mailed the claimant at 2.38pm to inform her that the hearing would re-start at 2.45pm, and separately forwarded to the claimant the dial-in details;• The claimant did not connect to the hearing at 2.45pm.[2]The claimant has failed to make representations in writing why this should not be done or to request a hearing despite being invited to do so and has made no or no further contact with the Tribunal. The claim is therefore struck out.[3]The hearing fixed for 10, 11 and 12 July 2024 is cancelled.
