Miss E Hardie v Richard Wellock & Sons Ltd: 2408361/2022

EMPLOYMENT TRIBUNALS
Case No 2408361/2022
Miss E HardieClaimantRICHARD WELLOCK & SONS LTDRespondent
Employment Judge SlaterDate 2 June 2023

JUDGMENT

The claim is struck out.

REASONS

[1]By a letter dated 3 March 2023 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the claim should not be struck out because(i) she has failed to attend this hearing today and has not communicated to the Tribunal her reasons for not attending. The Claimant was notified of the hearing by letters from the Tribunal dated 28 October 2022 and on 14 February 2023 (Rule 47).(ii) the Respondent requested that the Claimant provide further information in relation to her claim. The Request for Further Information was made 4 January 2023. The Claimant was reminded of the Request for Further Information in the letter from EJ Slater of 14 February 2023. The Claimant has made no attempt to respond. Review of the case file indicates that other than the Claimant filing the claim no further steps have been taken by her to progress it. In short, there is no evidence to identify that the claimant is actively pursuing the claim.[2]The claimant has failed to make representations in writing, or has failed to make any sufficient representations, why this should not be done or to request a hearing. The claim is therefore struck out.[3]The hearing fixed for 26, 27 and 28 November 2024 will not take place.
