JUDGMENT
[1]The claimant’s claim seeking unpaid notice pay is well founded and succeeds.[2]The claimant’s contractual notice period was 1 week.[3]The claimant gave notice in writing and was not paid that notice period.[4]The respondent was unable to prove that the claimant was guilty of gross misconduct which meant that the respondent was entitled to dismiss.[5]Accordingly, the respondent must pay the claimant the gross sum of £961 in respect of the unpaid notice pay.[6]It is acknowledged that other contractual disputes may remain in issue between the parties, but do not form part of the claim being determined in these proceedings and the Tribunal does not have jurisdiction to hear them. These matters may of course be determined in another forum if they remain unresolved.
