Mr A J Dalton v Precedent Surveyors Ltd: 2407742/2023
JUDGMENT
The claim for a redundancy payment is struck out.REASONS
[1]By a letter dated 9 December 2023, the Tribunal gave the claimant an opportunity to make representations as to why the claim for a redundancy payment should not be struck out because• the claimant has insufficient service with the respondent to bring such a claim, so the Tribunal does not have jurisdiction to hear it.[2]The claimant has failed to make representations in writing, or has failed to make any sufficient representations, why this should not be done or to request a hearing. The claim is therefore struck out.[3]The claimant’s other claims are not affected by this judgment. ________________________ Employment Judge KM Ross Date: 23 January 2024[1]The respondent has made an unauthorised deduction from the claimant's wages and is ordered to pay the claimant the gross sum of £9,723.92.[2]The respondent breached the claimant’s contract in respect of mileage allowance and the respondent is ordered to pay damages to the claimant in the sum of £1,124.[3]The respondent has failed to pay the claimant’s accrued but unpaid annual leave entitlement and is ordered to pay the claimant the gross sum of £1,213.8.
