JUDGMENT

[1]The respondent has made an unauthorised deduction from the claimant's wages and is ordered to pay him the net sum of £821.10 representing the amount of pay he should have received if the respondent had or could have obtained this sum from HMRC under the applicable Treasury Directions. The amount due is calculated as follows.[2]The claimant worked variable hours and received £44.63 per week net average earnings. The period of furlough was 5 November 2020 to 12 April 2021 = 23 weeks.[3]Furlough pay based on 80% of average wage is £35.70 per week x 23 = total sum due £821.60
