JUDGMENT

[1]On 15 October 2021 Employment Judge Johnson warned the claimant that he was considering a strike out of all claims on the basis the claimant had failed to actively pursue his claims.[2]The claimant did not respond positively to that warning by 5 November 2021 as requested.[3]Consequently, as the claimant did not attend at this hearing today, all his claims relating to unfair dismissal, a claim relating to the breach of the duty to make reasonable adjustments and a claim relating to discrimination arising from disability are all stuck out on the basis that they have not been actively pursued. (Rule 37(1)(d) of the Employment Tribunal (Constitution and Rules of Procedure) Regulations 2013 applies).[4]The final hearing arranged for 11 12 13 January 2023 is cancelled.
