JUDGMENT

The claim is struck out.

REASONS

[1]Rule 37 of the Employment Tribunal Rules of Procedure gives the tribunal the power to strike out part of a claim on the ground that the claimant has not complied with a case management order and/or that it has not been actively pursued.[2]The claimant presented her claim on 20 July 2023.[3]Notice of the claim and notice of the final hearing were sent to the parties in a letter dated 9 August 2023. The letter gave the correspondence address for the North West Regional Office in Manchester. It also instructed the claimant to provide a document to the respondent setting out what her losses were. This was required to be done by 20 September 2023. The parties were required to send their relevant documents to each other by 4 October 2023.[4]Since then, the claimant has not made any contact with the tribunal office in the North West Region and appears not to have contacted the respondent either.[5]The claimant did e-mail the Wales Employment Tribunal Office on 17 November 2023 to say that she would not be able to attend the final hearing. The next day, an e-mail was sent on behalf of the Wales Employment Tribunal to inform her that her correspondence should be sent to the North West Region. The correct e-mail address was provided to her.[6]The claimant has not been in contact since then.[7]By a letter e-mailed to the claimant on 17 November 2023, the claimant was given an opportunity to make representations, or to request a hearing, on the question of whether or not her claim should be struck out. She has not replied.[8]The claimant has not pursued her claim actively. There is no reason why the claim should not be struck out. 1 of 2 Case Number: 2407559/2023 2407577/2023
